Unlicensed Massage Tenants Can Lead to Criminal Charges
As a property owner, leasing your unit can come with significant legal responsibilities. A recent enforcement action highlights a critical risk: the landlord can face severe criminal penalties if the tenant operates an unlicensed massage establishment.

The Case Breakdown
October 2025 (The Violation): Authorities conducting an enforcement check along Upper Serangoon Road discovered a massage establishment operating without a valid license. The Operator pleaded guilty and was fined $10,000.
April 2026 (The Charge): The landlord of the premises was officially charged for suspected involvement in knowingly allowing the tenant to carry on the unlicensed business.
What Does the Law Say?
Under Section 5(4) of the Massage Establishment Act 2017:
The Tenant's Offense: Providing massage services in an establishment without a valid license is a direct criminal offense.
The Landlord's Liability: A landlord who allows a tenant to conduct unlicensed massage services on their premises is deemed to have committed an offense under the same section of the law.
Key Takeaway: Ignorance or turning a blind eye is not a legal defense if you knowingly permit the activity.
The Cost of Non-Compliance
If convicted under the Act, the penalties for the landlord are severe:
A fine not exceeding $10,000
Jail time for a term not exceeding two years
Both the fine and imprisonment
How Landlords Can Protect Themselves
To mitigate your legal risks when leasing to wellness, spa, or beauty businesses, ensure you take these immediate steps:
Verify Licenses Prior to Key Handover: Do not rely on verbal promises. Demand a physical copy of the approved licenses from the relevant authorities before the lease begins.
Conduct Regular Site Inspections: Build mandatory, periodic property inspections into your tenancy agreement to ensure the business aligns with the permitted use.
Include Strict Termination Clauses: Ensure your lease explicitly states that any illegal operations or failure to maintain required statutory licenses will result in an immediate breach of contract and lease termination.
